Nintendo has always been against the cheat devices in the past. Here's an example of a court case concerning Galoob's Game-Genie:

After they lost that case, they started making several versions of games to deter hackers (i.e. v1.0, v1.1, etc.). Don't forget, Nintendo also blocked Datel's Action Replay (1.14b and older) on the Wii with System Menu 3.0, then later blocked most of the rest of Datel's products from being used on the Wii (such as the Freeloader). If I'm not mistaken, the Action Replay DS is blocked on the DSi as well. Nintendo isn't very fond of unlicensed products being released/made on their systems apparently, as they always seem to go out of their way to block them.
Currently "retired" from hacking codes.

While the loss of VC may be true,  that only means you can't use your SD backups of them.  They will most likely have transferred your shop account and as a result, the rights to redownload them.  Likewise, if you have any DLC for any wiiware or disc based games,  you should be able to redownload those as well.

I think it is strange that they have not blocked the newer version of gamecube action replay(which does work  on 4.0 firmware) anyone know why they haven't decided to block it.

you probably don't have the latest version.

You can downgrade your MIOS to save money. Don't bother buying another AR.

Is it possible to just downgrade your mios so that the older gamecube action replay's work.In the future when their is another wii firmware update can someone let us know if the mios has been updated as this will probably block the action replay right.

If you know how to edit WAD's do a HEX edit text search for GHNE in any blocked version of MIOS. Change this bytes to something else, and Datel's black list is removed.

This can be added to patchmii or anything program like that also.

basically mios just stores a black list of game ID's, and you just need to edit to remove that list.

Its handy if you want to use a newer mios and still use Datels products.

other blacklisted ID's are unknown, i'm 100% one is Phantasy star online, i think maybe they blocked all BBA games for Wii.

PSO has been blocked on all wiis. Since begining. It doesn't have the right modes so nintendo blocked it. There is no LAN adapter on a wii.

Because there is an exploit in PSO that allowed you to run unsigned code on the gamecube.

Um.. that exploit only works if you have a Broadband Adapter.. which doesn't work on Wii.. so the exploit is "fixed" (more of a work-around)
