Legal question about cMIOS here

I have a cMIOS that allows booting of gamecube homebrew and that does not contain any backup specific code. It can be used to launch my loader that allows to use wiird on gamecube games, but can't be used to launch games with Gecko OS for gamecube edition.

The problem is that gamecube backup launching is also possible with this. I repeat, the patcher doesn't contain backup specifc code.

Question to the mods: Can i link this cMIOS here?

OT: The release of the loader with wiird for gamecube will take a while longer, i haven't even played around with Ocarina on gamecube games yet.

While I'm not a mod and my opinion doesn't carry any weight, I'll throw my $0.02 in anyway.

I think it should be acceptable to link to it.  Homebrew Channel doesn't contain backup specific code either, but it can be used to launch backups.  No one has a problem with discussing it.  Obviously, discussion of how to use it for GameCube backups would probably not be permitted, but discussion of using it for WiiRd/Ocarina for GameCube games should be permitted, IMHO.  Particularly since this is the only way to get Ocarina to work on GameCube games, period.  It should probably be mentioned that we endorse use of the GameCube Backup Launcher already to boot the GeckoOS ISO; I don't really see any difference between that and this.

As an aside, if we're concerned about the piracy impact to Nintendo, Nintendo is making little to no money on GameCube games anymore, and they cost about $5 used... so even if a few people use the cMIOS with a backup launcher to boot pirated GameCube games, the actual monetary impact to Nintendo would be minuscule compared to that of Wii/WiiWare/VC piracy.  Not that we should allow discussion of said piracy here, but banning legit discussion of WiiRd/Ocarina in the name of reducing GameCube piracy would be a bit extreme, IMHO.

Okay, that's my $0.02.  Now someone who actually matters can chime in.  :)

I'm inclined to allow it since it wasn't designed for running piracy, but I'm the least senior moderator so I probably have the least say.  Someone should ping Link...I would think he has the final say.

I guess we could accept that here - MIOS modifications are also quite safe to use (in worst case you brick your Gamecube mode but you can still retry installing and unbrick it - so high safety guaranteed)

And well.. if it's for Gecko purposes then okay by me!

Not that my opinion matters, but wouldnt a MIOS be considered free anyway? I mean the updates are free, and I do recall that nintendo DID have an update to the MIOS removing the ability to use a Gamecube Action replay that is made for the wii (original gamecube edition action replays only worked on the gamecube, and datel released a wii version for gamecube games)

Action Replay is one of the reasons why i use MIOSv4 as base. If you have an Action Replay and it ever worked on Wii, it should work now.

Well, MIOS is free yes.. however.. it is still licensed Nintendo code.. so while you do not pay for it it's no free and shareware in the typical sense of meaning.. you can get a free CD at some store and it can still say "You mustn't upload the contents of this CD online". Same kinda for MIOS. There are ways to get it legally - I personally recommend NUS downloader. NUS Downloader basically uses the official Nintendo server. Unfortunately as there is no agreement being shipped along MIOS we do not know how strict Nintendo is about publishing their stuff.. it is completely legal to get NUS Downloader, NUS Downloader as an application to use is absoltely legal and the fact that NUS Downloader can download MIOS to your PC is also perfectly legal.However, in the end that does not mean that MIOS is free for all uses.

So it's very tricky!

True.. personally I do not care for people too who have modchips, CIOSCorp or anything to play Wii copies.. or Gamecube copies.. or whatever.. if people use another cMIOS for that loader to load Gamecube backups then I am fine with it.

The main reason about the zero tolerance policy about backups: first of all.. I want this place to be a code discussion place. And it is not supposed to end up to "How would I pirate my games" which seem to be the 90% reason for people to visit gbatemp.net - that's just it: if people use piracy copies.. then it's not of my problem.. see Super Mario Galaxy 2 US.. that's obviously a piracy copy people base their codes on!
