Hopefully Nintendo learned their lesson from Sony's OtherOS. If you give "good enough" homebrew for hackers, they won't crack your security. If hackers don't crack the security, it will take the skill-less pirates a long time to break it.
Think it's a coincidence that once OtherOS was gone, hackers suddenly found out that Sony did a massive cryptographic no-no by using the same random seed for all of the PS3 keys?
It'll be hackable. 3DS had homebrew on the day of release (I think, I don't own one).
